1. About Motherland
Motherland is an online doula support, birth education and coaching service operated by Anna Bergman, registered in Sweden. Our website is motherlandbirth.com. By accessing our website or purchasing any of our services, you agree to be bound by these terms and conditions in full.
2. Nature of our services
Motherland provides online birth preparation, doula support, postpartum support, coaching, educational content and community experiences. All services are non-medical in nature.
Nothing provided by Motherland — including voice notes, written materials, video content, live sessions, personal communication or coaching — constitutes medical advice, medical diagnosis, or medical treatment of any kind. Our services are intended to provide emotional support, education, preparation and general information, and are not a substitute for the advice of a qualified healthcare provider, midwife, obstetrician or other medical professional.
Coaching services may involve elements of transformational support, holistic health and wellness guidance, and postpartum education. Deciding how to handle any issues that arise, and implementing any choices discussed, is exclusively your responsibility.
You are solely responsible for all decisions made regarding your pregnancy, birth and postpartum care. Motherland expressly disclaims any and all liability for any medical outcomes, complications, injuries or adverse events arising before, during or after birth, regardless of whether you have used our services.
In case of a medical emergency, contact your local emergency services immediately. Do not delay seeking medical attention because of anything communicated through Motherland’s services or website.
3. Eligibility
Our services are intended for adults aged 18 and over. By purchasing or using our services you confirm that you are at least 18 years of age and that the information you provide to us is accurate and complete.
4. Purchasing and payment
By completing a purchase you enter into a binding agreement with Motherland. Payments are processed securely through Stripe, a third-party payment processor. Motherland does not store your payment card details.
Prices are displayed inclusive of applicable VAT where required by law. Motherland reserves the right to change pricing at any time, provided that any changes will not affect purchases already completed.
5. Payment plans
Where payment plans are offered, you agree to complete all scheduled payments in full regardless of whether you continue to use the service. Failure to complete payments may result in immediate loss of access to the service and may result in the outstanding amount being pursued through debt recovery.
6. Refund and cancellation policy
Because our services are personal in nature and preparation begins immediately upon purchase, we do not offer refunds once access to our services has been granted or our work together has begun.
If you are unable to continue due to unexpected medical circumstances or pregnancy complications, please contact us directly and we will do our best to find a fair solution.
We reserve the right to cancel or discontinue any service at any time. In the event that Motherland cancels a service for which you have paid, a full or partial refund will be issued at our discretion.
7. Rescheduling and cancellations
Where scheduled calls or sessions are included in your service, please provide as much notice as possible if you need to reschedule. Cancellations or no-shows within 24 hours of a scheduled session are subject to the full session fee. Anna reserves the right to reschedule sessions and will coordinate a new time with you.
8. Communication via Telegram
Motherland uses Telegram as the primary platform for direct communication and support delivery. By purchasing a service that includes Telegram support, you consent to communicating through this platform. Anna is available on Telegram during the terms specified for your specific service. Response times vary by service and are outlined at the point of purchase. If you are experiencing a medical emergency, contact your local emergency services immediately rather than reaching out via Telegram.
9. Confidentiality
All personal information and communication shared with Motherland is treated with strict confidentiality. Sessions and conversations are not recorded without your explicit consent. We will never share your personal information with third parties except where required by law or where necessary to deliver the service.
Disclosure may be required in the following circumstances: where there is a reasonable suspicion of risk to you or others; where disclosure is required by applicable law or legal proceedings; or where your mental state is at issue in legal proceedings.
Voice notes, written materials or other content created by Anna that do not contain any client-specific or identifying information may be used in media and marketing materials by Motherland.
The confidentiality provisions of this agreement shall survive its termination.
10. Your responsibilities
You agree to engage with our services in good faith, communicate honestly, be open to feedback, and provide accurate information. You agree to create the time and energy to participate in the services you have purchased. You agree not to share, distribute or reproduce any materials provided by Motherland without written permission. You agree to treat all communications with Motherland with respect and professionalism.
11. Intellectual property
All content created by Motherland — including but not limited to voice notes, audio recordings, written materials, workbooks, video content and website copy — is the exclusive intellectual property of Motherland and Anna Bergman and is protected by applicable copyright law. You are granted a personal, non-transferable licence to use materials for your own private use only. You may not reproduce, distribute, sell, share or use any Motherland materials for commercial purposes without prior written consent.
12. Disclaimer of medical and coaching liability
Motherland and Anna Bergman are not medical professionals and do not provide medical services of any kind. Anna is not a licensed therapist, psychiatrist, psychologist or medical care provider and has no expertise in diagnosing or treating medical, psychological or clinical conditions.
Motherland expressly disclaims all liability for:
— Any medical complications, injuries or adverse outcomes arising during pregnancy, birth or the postpartum period
— Any decisions made by you or your healthcare providers in relation to your care
— Any reliance on information provided through our services that results in harm to you, your baby or any other person
— Any outcomes arising from the use or non-use of techniques, tools or practices shared through our services
You should never disregard medical or professional advice or delay seeking it because of anything communicated through Motherland’s services. Our services are not a substitute for professional medical, psychological or therapeutic care.
Your birth experience, postpartum recovery and medical outcomes are solely the responsibility of you and your qualified healthcare team.
13. Limitation of liability
To the maximum extent permitted by applicable law, Motherland’s total liability to you for any claims arising out of or related to our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.
14. Data protection and privacy
Motherland processes your personal data in accordance with the General Data Protection Regulation (GDPR) and applicable European data protection law. For full details of how we collect, store and use your personal data, please refer to our Privacy Policy at motherlandbirth.com.
15. Governing law and jurisdiction
These terms and conditions are governed by the laws of Sweden and the European Union. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the Swedish courts, without prejudice to your rights as a consumer under applicable European consumer protection law.
If a dispute arises that cannot be resolved by mutual consent, the parties agree to attempt to resolve the matter in good faith before initiating any legal proceedings.
16. Changes to these terms
Motherland reserves the right to update or amend these terms at any time. Updated terms will be posted on our website with a revised date. Your continued use of our services following any changes constitutes your acceptance of the updated terms.
17. Severability
If any provision of these terms is held to be invalid or unenforceable under applicable law, that provision shall be amended to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
18. Entire agreement
These terms reflect the entire agreement between you and Motherland with respect to the subject matter and supersede all prior written and oral representations.
